The Vital Records Department Issues all Birth, Death and Marriage Licenses

Birth Certificates

A certified birth certificate can only be issued to the person on the birth certificate or parent of the person on the birth certificate. Only by order of a New York State Court may a spouse, child or other person obtain the certificate. Vital Records only has birth certificates for persons born in Our Lady of Victory Hospital. To obtain a birth certificate, you need to supply your birth name, mother’s maiden name, fathers name and date of birth, along with a copy of your driver’s license or two picture identifications. Marriage Certificates

Certificates of marriage can only be done if the couple originally obtained their marriage license in the City of Lackawanna. A Certified Marriage Certificate can only be issued to the person(s) on the original license. In some instances other people who have a documented judicial or other proper purpose, or posses a New York State Court Order may obtain a Certified Marriage Certificate. If you are not a spouse, you must document a judicial or other proper purpose. For example, you may need a marriage certificate to claim a benefit. You would need an official letter from the agency stating that you need the marriage record to process the claim. 

The cost of a marriage certificate is $10.00. Out of State Applicants must pay in the form of money order or cashier’s check. No personal out-of-state checks accepted.

Death Certificates

A certified death certificate can only be issued to the spouse, parent, sibling  or  child  of the  deceased,  persons  with  a New York  State Court  order  or  persons  requiring  the  record  for  a legal, medical, or one needed for official purposes by State or Federal agencies. Only persons who expired in Our Lady of Victory Hospital or at home within the city limits would have a death certificate on file. To obtain a death certificate, you need to supply a copy of your driver’s license or two picture identifications.  Cost is $10.00  per certificate, except for genealogy. (The cost of a UNCERTIFIED death certificate (genealogy  purposes) is $5.00.)

Marriage Licenses

Persons over the age of 18 may apply for a marriage license without parental consent. The couple must appear in person with proper identification (certified birth certificate, driver’s license, and/or passport) to apply for the marriage license. Marriage licenses must be obtained at least 24 hours before the marriage ceremony can take place per New York State Law and the license expires in 60 days. You can apply for a marriage license anywhere in New York State as long as you are getting married in New York State. 

Due to the extended time it takes to complete a marriage license application, it is highly recommended that you call ahead to secure an appointment with the Clerk’s Office. It is suggested that you schedule an appointment earlier in the day.

The cost of a marriage license is $40.00. We accept cash, checks and credit card (2.95% fee).
